7) Programs with Set Durations; Attendance

    • Cohort-based or time-bound programs include scheduled start/end dates, sessions, and milestones. Your enrollment grants access for the program’s duration and any stated replays or materials access window.

    • Missed sessions may not be eligible for make-ups or refunds unless explicitly stated for the specific program.

9) Refunds, Cancellations, and Transfers; Consumer Right of Withdrawal (EU/EEA)

Consumer Right of Withdrawal

    • If you are a consumer residing in the EU/EEA and purchase at a distance (e.g., online), you have a statutory 14-day right to withdraw from your purchase without giving any reason.
        • For services/courses: the 14 days run from the day of contract conclusion.

        • For digital content not supplied on a tangible medium (e.g., downloads/streams): the 14 days run from the day of contract conclusion.

    • Do not share private community spaces, links, or materials with non-participants.

    • Respect the confidentiality of discussions, peer contributions, and shared professional experiences within the platform.

    • We may remove participants who violate these standards without a refund where permitted by law. Any removal will be proportionate to the breach and subject to applicable consumer protection laws.

11) Intellectual Property and License

    • The Site and all content, materials, curricula, videos, audios, workbooks, and resources are owned by Wefi Leaderhood or our licensors and are protected by intellectual property laws.

    • Your enrollment provides a personal, non-exclusive, non-transferable license to access and use materials solely for your own professional learning during the access window stated for your product/program.

    • You may not copy, share, resell, record, distribute, or create derivative works from program materials without our prior written consent. This clause does not limit any mandatory statutory exceptions (e.g., quotation, teaching) under applicable copyright law.

12) User-Generated Content; Testimonials

    • If you submit comments, posts, assignments, or testimonials, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content in connection with the Services. You can withdraw testimonial permissions by writing to admin@wefileaderhood.com; this will not affect uses already made in good faith.

    • We process testimonials and user content under a suitable legal basis under GDPR (e.g., consent or legitimate interests). You can object to processing based on legitimate interests at any time on grounds relating to your situation.

    • Do not post content that infringes others’ rights or contains confidential or unlawful material.

13) Third-Party Services and Links

    • We may use or link to third-party platforms (e.g., learning management systems, video conferencing, payment providers). Your use of those services may be subject to their own terms and privacy policies.

    • We are not responsible for third-party content, availability, or practices.

14) Confidentiality and Privacy

    • We act as controller for most processing we initiate. For third-party platforms used to deliver the Services, those providers act as independent controllers or processors as described in their terms and our Privacy Policy.

    • Training programs are collaborative by nature; we ask all participants to respect the confidentiality of peers and any professional information shared during sessions. We cannot guarantee that other participants will always comply.

15) Audio/Video Recording

    • Some sessions may be recorded for participants’ later viewing or for quality/training purposes. We will inform you when recording occurs. The legal basis may be consent or our legitimate interests (e.g., providing replays or improving training quality). Where consent is used, you may withdraw it at any time without affecting prior processing. Where legitimate interests are used, you may object at any time on grounds relating to your situation.

    • If you do not wish to appear, keep your camera/microphone off, use a pseudonym where allowed, and avoid sharing personal data during those sessions. Parental consent is required where minors may appear.

16) Disclaimers; Limitation of Liability

    • The Services are provided “as is” and “as available” to the extent permitted by law. We do not make guarantees regarding outcomes. Nothing excludes warranties, rights, or remedies that cannot be excluded under applicable law.

    • To the maximum extent permitted by law, Wefi Leaderhood will not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, data, reputation, or business interruption arising from or in connection with the Services. For other losses, our aggregate liability is limited to the amount you paid to us for the specific product/service giving rise to the claim in the 12 months preceding the event.

The above limitations do not apply to:

    • Liability for death or personal injury caused by our negligence

    • Liability for intent or gross negligence

    • Liability under the Austrian Product Liability Act

    • Any other liability that cannot be limited or excluded under applicable law (including mandatory consumer protections)

17) Indemnification

You agree to indemnify and hold harmless Wefi Leaderhood and its officers, employees, and contractors from third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your unlawful use of the Services or your material breach of these Terms, to the extent you are at fault and only to the extent permitted by applicable law. This does not limit your statutory rights as a consumer.

18) Force Majeure

We will not be liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, war, strikes, labor disputes, epidemics, governmental actions, power or internet failures, or platform outages.

19) Changes to Services and Terms

We may modify or discontinue features, content, or offerings at any time. We may update these Terms from time to time. The updated Terms will be posted on the Site with a revised Effective Date. We will provide reasonable advance notice of material changes where feasible. Changes do not retroactively affect purchases already concluded. For ongoing subscriptions, changes will take effect from the next billing cycle after notice.

20) Governing Law; Dispute Resolution

    • These Terms are governed by the laws of the Republic of Austria, including the Austrian Civil Code (ABGB) and the Associations Act (Vereinsgesetz 2002), without regard to conflict-of-laws principles.

    • For business users (Unternehmer), the exclusive place of jurisdiction is the competent court in Vienna, Austria. For consumers (Verbraucher), the competent courts are those mandated by law; you may bring claims in your place of residence as provided by consumer protection rules.

    • Jury trials do not apply in Austrian civil proceedings.

    • Where both parties agree, disputes may first be submitted to mediation (e.g., VIAC Mediation Rules) without prejudice to the right to seek interim relief.

21) Severability; Entire Agreement; Assignment

    • If any provision is found unenforceable, the remaining provisions remain in effect.

    • These Terms, together with any program-specific terms, order forms, and our Privacy Policy, constitute the entire agreement between you and us regarding the Services.

    • You may not assign your rights or obligations under these Terms without our prior written consent. We may assign to an affiliate or in connection with a reorganization or transfer of activities, provided this does not unreasonably prejudice your rights as a consumer; we will notify you of any such assignment where required by law.
